These Terms of Service ("Terms") contain important information about your rights and obligations. Please read them carefully before using our website medikout.com and all related websites (the "Website"). If you do not agree to these Terms, please do not use the Website. By using the Website, you agree to be bound by these Terms and all applicable laws, rules, and regulations.

The terms "Medikout", "we", "us", and "our" mean ADTECH PROMOTIONS MARKETING SERVICES VIA SOCIAL MEDIA CO. L.L.C, which provides the services described in these Terms via the Website.

Our Privacy Notice describes how personal data is collected and used in connection with your use of the Website and our services.

Entire agreement

These Terms, together with the Privacy Notice and Cookie Policy, form the agreement between Medikout and each user of the Website in relation to the user’s access to and use of the Website and the patient-facing services made available through it.

For the avoidance of doubt, any separate clinic agreement, order form, statement of work, pricing schedule, or other commercial document entered into between Medikout and a Clinic governs only the business relationship between Medikout and that Clinic and does not form part of these Terms for patients or other Website users.

By using the Website, you represent and warrant that:

  • you have read these Terms, understand their content, and agree to comply with them;
  • you have full legal capacity to use the Website under the laws applicable to you;
  • you will comply with all applicable laws, regulations, and third-party rights in connection with your use of the Website; and
  • if you do not agree with these Terms, you will not use the Website.

Services

In brief: On the Website, users can submit requests and receive information, recommendations, and communications relating to relevant Clinics. Medikout helps users connect with independent Clinics and supports inquiry handling and related communications.

Our services

The Website is a platform that provides users with information about medical services and Clinics where such services may be available ("Clinics" or "Medical Centers").

On the Website, Medikout may:

  • collect information from users about their medical request;
  • allow users to upload photos, scans, or other supporting materials voluntarily;
  • allow users to provide contact information, including a WhatsApp number or other supported messaging contact;
  • verify contact details by code, where this step is enabled;
  • generate and display clinic recommendations based on the information provided by the user;
  • use internal tools and criteria to help manage, prioritise, classify, and route inquiries;
  • transfer user requests and related information to relevant Clinics, where permitted and necessary for the service;
  • make inquiries available to Clinics through technical or operational channels;
  • facilitate service-related communications between users and Clinics through supported channels, including messaging channels such as WhatsApp; and
  • contact users regarding their inquiry through the communication channels provided by the user, subject to applicable law and consent where required.

Medikout does not assign a user to a specific Clinic or doctor as a medical authority. Medikout aims to help users receive responses from relevant independent Clinics based on the information submitted.

Medikout is not a medical services provider and is not responsible for the provision of medical care by any Clinic.

MEDIKOUT IS NOT A LICENSED MEDICAL CARE PROVIDER, AND NONE OF ITS SERVICES OR APPLICATIONS IS INTENDED TO REPLACE PROFESSIONAL MEDICAL ADVICE OR TO DIAGNOSE, TREAT, OR MANAGE ANY ILLNESS OR MEDICAL CONDITION.

NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING READ OR RECEIVED THROUGH THE WEBSITE OR OUR SERVICES. ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL IF YOU HAVE ANY QUESTIONS OR CONCERNS ABOUT YOUR HEALTH OR CONDITION. Monitoring of service delivery

Medikout reserves the right to monitor and review the provision of services connected with inquiries submitted through the platform for the purposes of:

  • ensuring compliance with applicable quality standards and service protocols;
  • verifying that services are actually rendered as described or agreed;
  • detecting, preventing, and investigating fraudulent, deceptive, abusive, or unlawful activity; and
  • protecting the interests and safety of users and the integrity of the platform.

Such monitoring may include reviewing service records, communication records, feedback, and other relevant information associated with the delivery of services. Medikout will process any personal data collected in the course of such monitoring in accordance with the Privacy Notice and applicable law.

How we handle inquiries

When a user submits a request through the Website, Medikout may collect the information provided by the user, including contact details, details of the requested service, supporting materials, and any additional information voluntarily submitted.

Medikout may use internal tools and criteria to help manage, prioritise, classify, and route inquiries. Such tools do not constitute a medical opinion, diagnosis, prognosis, treatment recommendation, eligibility determination, or guarantee of outcome.

A user who provides a WhatsApp number or another supported messaging contact may receive an initial message from Medikout in connection with the submitted inquiry. Such message may be used to confirm the inquiry, provide service information, support follow-up, or enable further inquiry handling.

If the user chooses to communicate with a Clinic through a supported messaging channel, Medikout may facilitate a messaging chat between the user and the relevant Clinic using Medikout’s systems, CRM, integrations, or connected technical tools.

In such a chat, messages may be sent by Medikout, by the Clinic, or automatically by Medikout’s systems. Where technically feasible, Medikout may indicate, label, or otherwise identify the source of a message.

Any messaging channel facilitated by Medikout is intended to support inquiry handling, appointment coordination, administrative follow-up, and related service communications. Medikout does not provide medical advice, diagnosis, treatment, or medical eligibility decisions through such channels.

Patient journey

In brief: A user may come from an advertisement or another source, answer questions on the Website, optionally upload supporting materials, provide contact details, receive a recommendation, and continue communication through supported channels.

A user may interact with the Website as follows:

  • sees an advertisement or another source referring the user to the Website;
  • visits the Website;
  • answers questions on the Website;
  • uploads photos, scans, or other supporting materials, if desired;
  • leaves contact details, including a WhatsApp number or another supported messaging contact;
  • verifies the contact details by code, where this step is enabled;
  • receives a clinic recommendation on the Website or through follow-up communication;
  • may receive an initial message from Medikout regarding the inquiry; and
  • may choose to continue communication with Medikout and, where available, with a relevant Clinic through a supported channel.

The user may skip some steps depending on the country, campaign, device, user path, or technical setup.

Medikout may contact the user through WhatsApp, phone, email, SMS, or other communication channels provided by the user in connection with the user’s inquiry.

Such service-related communications may include confirming submitted information, verifying contact details, sharing or following up on clinic recommendations, assisting with the inquiry process, enabling communication with a Clinic, checking whether a Clinic has contacted the user, and sending other updates directly related to the user’s request.

Clinics

Clinics presented or connected through the Website are independent medical providers. Medikout does not own, manage, supervise, or control the medical practice of any Clinic.

Clinics use Medikout’s business services, including lead generation, CRM access, and related operational tools, under separate clinic agreements, order forms, or other commercial documents concluded directly with Medikout.

Those separate documents govern the commercial, operational, and data protection arrangements between Medikout and Clinics and do not form part of these Terms for users.

Clinics are solely responsible for the content, legality, accuracy, appropriateness, and consequences of their communications with users, including any medical advice, treatment information, commercial offers, pricing, disclosures, consent requests, and follow-up communications.

Consent and health data

By submitting information through the Website, the user understands that the information may include health-related or other sensitive data, such as information about the requested treatment, photographs, scans, or other medical context.

The user confirms that any such information is submitted voluntarily and may be shared with relevant Clinics for the purpose of matching, referral, follow-up, inquiry handling, and related services, where permitted by law and subject to the Privacy Notice and any required consent.

Where required by applicable law, Medikout will request explicit consent before collecting, using, or transferring special category data. If the user does not want to provide such data, the user should not upload it and may use any alternative flow that does not require it, if available.

Medikout applies appropriate technical and organisational safeguards to protect personal data. However, no method of transmission over the internet or via third-party communication channels is completely secure.

Account

Medikout does not currently provide personal user accounts or patient dashboards unless expressly stated otherwise on the Website. Users may submit inquiries through available forms and communication channels. Clinic accounts may be available only to approved Clinic representatives under separate clinic arrangements.

Content

In brief: Medikout owns the Website and its content or uses such content lawfully. Users receive a limited right to use the Website and content for personal purposes in accordance with these Terms.

All materials on the Website, including text, graphics, information, images, icons, photographs, video, audio, software, code, trademarks, logos, and other materials (together, the "Content"), and all intellectual property rights in them, are owned by Medikout or used with permission.

The Content is protected by applicable intellectual property laws. Except as expressly allowed by these Terms or applicable law, no right, title, or interest in the Content is transferred to the user.

Personal use

Subject to these Terms, Medikout grants the user a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and view the Website and Content for personal, non-commercial use.

Commercial use

The use of the Website or Content for commercial purposes requires Medikout’s prior written permission and may be subject to additional terms and fees.

Third-party sites and services

Some functions of the Website or related communications may rely on third-party websites, messaging services, software providers, integrations, or platforms that Medikout does not control, including WhatsApp and other communication services.

The use of such third-party websites and services is governed by their own terms and privacy notices. Medikout is not responsible for:

Disclaimer of warranties

To the maximum extent permitted by law, Medikout makes no guarantees or warranties regarding the Website, Content, or services, except as expressly stated in these Terms.

In particular, Medikout does not warrant that:

  • the Website or services will be uninterrupted, error-free, or free of viruses or harmful components;
  • the Content is accurate, reliable, complete, useful, or fit for a particular purpose;
  • any Clinic will contact a user;
  • any user will receive an offer, booking, consultation, treatment, or desired outcome from any Clinic; or
  • any internal tool, score, criterion, or classification used by Medikout will predict medical or commercial outcomes.

Limitation of liability

To the maximum extent permitted by law, Medikout, its founders, directors, officers, employees, contractors, agents, affiliates, successors, and assigns are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, loss of profits, loss of revenue, loss of goodwill, loss of data, or reputational harm arising out of or in connection with the use of, or inability to use, the Website, services, Content, or communications facilitated through the platform.

Medikout is not responsible for medical decisions, treatment outcomes, malpractice, or any healthcare or commercial service provided by a Clinic.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

Indemnification

To the maximum extent permitted by applicable law, the user agrees to indemnify, defend, and hold harmless Medikout and its affiliates, officers, employees, contractors, and agents from and against claims, liabilities, losses, damages, costs, and expenses arising from:

  • the user’s breach of these Terms;
  • the user’s misuse of the Website or services; or
  • the user’s violation of applicable law or third-party rights.

Payment terms

Medikout may receive commercial compensation from Clinics or partners. Specific commercial terms are governed by separate agreements.

Applicable law and jurisdiction

These Terms are governed by and interpreted in accordance with the laws of Dubai International Financial Centre (DIFC), UAE, without prejudice to any mandatory consumer rights available under the laws of the user’s country of residence.

Any dispute, conflict, claim, or disagreement arising directly or indirectly in connection with the Website or these Terms shall first be addressed through good-faith negotiations.

If the dispute cannot be resolved amicably, it shall be submitted to the competent courts of Dubai International Financial Centre (DIFC), UAE, unless otherwise required by applicable consumer protection law.

Any claim must be brought within one (1) year from the date on which it arose, unless a longer period is required by applicable law.

Electronic communications

By using the Website and providing contact details, the user agrees that Medikout may send electronic communications relating to:

  • the user’s inquiry;
  • updates to the Website or these Terms;
  • clinic matching and inquiry follow-up;
  • service-related notices; and
  • promotional offers, news, and updates, where permitted by law.

The user may opt out of marketing communications by following the instructions included in the relevant communication. Service-related communications may still be sent where necessary for the performance of the service or where otherwise permitted by law.

Other terms

If any provision of these Terms is held to be illegal, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

Medikout may transfer its rights and obligations under these Terms to a third party, provided that such transfer does not reduce the user’s rights under these Terms.

Medikout may update these Terms from time to time. Where a material change may affect the user’s rights or use of the Website, Medikout will provide notice within a reasonable time before the updated Terms become effective.

The printed version of these Terms is admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
